The short version
You’re buying a license to install and run sendbunny inside your own AWS account, plus our one-click installer service and an optional yearly updates subscription. Your install is yours to run forever, but the software stays ours: run it in your own account, don’t resell or re-host it for others, and don’t send spam with it. Everything is provided as-is, all sales are final (see the Refund Policy), and our liability is capped at what you paid us.
Who we are & acceptance
sendbunny (sendbunny.co) is a product of Growzill LLC (“we”, “us”). These terms are a binding agreement between you and Growzill LLC. You accept them by checking the acceptance box at checkout, completing a purchase, or using our paid services — whichever happens first. We record the version of these terms you accepted and a timestamp together with your license. If you buy on behalf of a company or organization, you confirm you have the authority to bind it to these terms.
What you’re buying
A sendbunny purchase includes:
- a personal license key,
- our one-click installer service, which deploys the sendbunny software into your own AWS account,
- the software license described in the next section, and
- optionally, an annual updates subscription for one-click updates from your dashboard.
The software is licensed, not sold. Nothing in these terms transfers ownership of the software or its source code to you.
License grant
Subject to payment and these terms, Growzill LLC grants you a perpetual, non-exclusive, non-transferable license to deploy, run, and modify the sendbunny software inside AWS accounts you own or control, for your own internal business use. The source code is delivered into your account for transparency and auditability, but it remains the property of Growzill LLC.
You may not:
- redistribute, publish, sell, rent, or sublicense the software or any modified version of it,
- offer the software to third parties as a hosted or managed service,
- share your license key, or
- remove proprietary notices from the code.
All rights not expressly granted here are reserved.
Your AWS account, your responsibility
sendbunny runs entirely in your AWS account. That independence is the point of the product, and it means you are responsible for that account: the AWS charges it incurs (SES, Lambda, DynamoDB, and so on are billed by AWS directly to you), keeping its credentials secure, obtaining SES production access and sending limits from AWS, your DNS records, your backups and data retention, and your compliance with AWS’s own terms. We never receive your AWS credentials and cannot operate, repair, or remove your install for you.
Acceptable use
sendbunny is for permission-based email only. You must not use it to send unsolicited commercial email (spam), and you must comply with the laws that apply to your sending — including CAN-SPAM, GDPR, CASL, and similar laws — and with AWS’s SES acceptable-use policy. The product automates unsubscribe handling and suppression; you must not circumvent them. If you breach this section we may terminate your services and revoke your license key, and AWS may independently suspend your sending.
What the product sends us
Your install never sends us your message content, contacts, analytics, or credentials. It makes three narrow calls to our infrastructure: an update check that fetches the release manifest from releases.sendbunny.co, an entitlement check carrying your license ID when you run a one-click update, and one-way install/update progress notifications so your deploy page can show a status bar. Annual updates subscription
The updates subscription is optional. It renews automatically each year through Stripe until you cancel; you can cancel anytime from your account, and your subscription then runs to the end of the paid period. If it lapses, your platform keeps working forever — you just stop receiving one-click updates until you renew, and renewing later picks up where you left off.
Lifetime license & upgrades
The one-time purchase is a lifetime license: perpetual, for the edition you bought. If you upgrade from Basic to Premium, a new Premium license is issued and your Basic license is retired — you hold one active license at a time.
Payments, pricing & taxes
Payments are processed by Stripe; your card details never touch our servers. Prices are shown at checkout in USD and may change for future purchases and renewals. Depending on your location, taxes may apply. All sales are final — the Refund Policy is part of these terms.
As-is, no warranty
The software and services are provided “as is” and “as available”, without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the software will be error-free, uninterrupted, free of bugs or security vulnerabilities, or that defects will be corrected. We do not warrant email deliverability: inbox placement depends on your content, your list quality, your domain and IP reputation, mailbox providers, and AWS — all outside our control. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.
Limitation of liability
To the maximum extent permitted by law, Growzill LLC is not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost data, business interruption, the cost of substitute services, your AWS charges, or damages arising from software defects, security incidents, unauthorized access, or failed or delayed email — even if we were advised such damages were possible. Our total liability under these terms is capped at the amount you paid us in the twelve months before the claim arose. Nothing here excludes liability that cannot be excluded by law.
Indemnification
You will indemnify and hold Growzill LLC harmless from third-party claims arising out of your sending activity, your content, your breach of these terms, or your violation of applicable law.
Termination & revocation
We may suspend or terminate your services and revoke your license key if you materially breach these terms — in particular the acceptable-use rules and the license restrictions — or if you initiate a chargeback instead of following the Refund Policy. If your license is terminated for breach, the license grant ends and you must stop using the software. Sections that by their nature survive (payments, warranty disclaimer, limitation of liability, governing law) survive termination.
Changes to these terms
We may update these terms from time to time. Changes are posted on this page with a new “last updated” date and version, and apply to purchases and renewals made after posting. The version you accepted at checkout stays recorded with your license.
Governing law
These terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws rules. The state and federal courts located in Cook County, Illinois have exclusive jurisdiction over any dispute arising from these terms, and both parties consent to venue there.
